Role Overview:
We are seeking experienced professionals to join our team as Associate Mental Capacity Assessors in the south of England. The role involves conducting comprehensive mental capacity assessments and preparing expert reports.
Key Responsibilities:
- Conduct mental capacity assessments for a range of decisions, including financial management, property affairs, testamentary capacity, and health & welfare.
- Prepare high-quality, court-compliant reports following the principles of the Mental Capacity Act 2005 and relevant case law.
- We support you to liaise with legal professionals, families, and deputies to gather relevant case information.
- Provide expert witness testimony in legal proceedings where necessary.
- Ensure all assessments are carried out with professionalism, impartiality, and adherence to legal and ethical standards.
Essential Requirements:
- Qualified Social Worker, Nurse, Occupational Therapist, Psychologist, or other relevant professional with experience in mental capacity assessments.
- Strong understanding of the Mental Capacity Act 2005, Court of Protection, and relevant legal frameworks(e.g., Banks v Goodfellow).
- Excellent report-writing skills, with the ability to produce structured, evidence-based, and legally defensible reports.
- Ability to work independently, manage workload effectively, and meet deadlines.
- Access to a car for travel (required for face-to-face assessments).
Desirable:
- Previous experience working with Court of Protection solicitors.
- Experience conducting retrospective capacity assessments and forensic reviews of complex cases.
- Knowledge of best interest decision-making frameworks and undue influence assessments.
