CQC Nominated Individual – Adult Social Care
Location: Aylesbury, Buckinghamshire
Reports to: Board / Directors
Responsible for: Executive oversight of CQC-regulated activities
Role Purpose
The Nominated Individual will represent the provider organisation in relation to its CQC-regulated activities and provide senior oversight of the management, quality, safety and regulatory compliance of the service.
The Nominated Individual will hold sufficient seniority and authority within the organisation to supervise the management of the regulated activity and hold the Registered Manager accountable for the effective operation of the service.
CQC Status Requirement
To act as Nominated Individual, the individual must:
- Be employed as a director, manager or secretary of the provider organisation.
- Be responsible for supervising the management of the carrying on of the regulated activity.
- Hold sufficient authority within the organisation to speak authoritatively on its behalf concerning the regulated activity.
- Meet the requirements of Regulation 6 of the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014.
Essential CQC Fitness Requirements
The Nominated Individual must:
- Be of good character.
- Have the necessary qualifications, competence, skills and experience to properly supervise management of the regulated activity.
- Be able, following reasonable adjustments where necessary, to properly undertake the role.
- Be able to provide or arrange availability of the information required under Schedule 3.
- Demonstrate honesty, integrity, reliability and appropriate professional conduct.
- Remain fit and suitable to undertake the role.
Experience & Competence
The successful candidate should demonstrate senior leadership and governance capability relevant to regulated adult social care, including:

Previous experience as a Nominated Individual, Registered Manager, Responsible Individual, senior adult-social-care manager or senior leader within a regulated health/social-care organisation is highly desirable.
Key Responsibilities
Regulatory Oversight
- Act as the organisation’s Nominated Individual for the relevant regulated activity.
- Maintain senior oversight of CQC compliance.
- Act as a principal senior contact with CQC in relation to the regulated activity.
- Ensure the organisation has appropriate resources and systems to comply with regulatory requirements.
- Ensure the Registered Manager understands and fulfils their regulatory responsibilities.
- Maintain oversight of required CQC notifications and significant regulatory matters.
- Ensure appropriate action is taken following CQC assessments, inspections or concerns.
Supervision of the Registered Manager
- Provide formal oversight and supervision of the Registered Manager.
- Establish clear objectives and accountability.
- Review the Registered Manager’s performance.
- Challenge poor performance or unsafe practice.
- Ensure identified concerns are addressed promptly.
- Ensure appropriate management cover and succession arrangements.
- Review key operational and quality indicators with the Registered Manager.
Governance
Maintain senior oversight of:
- Safeguarding.
- Incidents and accidents.
- Medication incidents.
- Complaints.
- Whistleblowing.
- Staffing levels.
- Recruitment compliance.
- Staff turnover and absence.
- Training and competency.
- Care/support-plan audits.
- Risk assessments.

Quality Assurance
Ensure effective systems exist to:
- Assess the quality and safety of services.
- Identify risks.

- Obtain feedback from people receiving support.
- Learn from complaints and safeguarding incidents.
- Produce improvement plans.
- Monitor completion of corrective actions.
- Promote continuous improvement.
Safeguarding
- Maintain executive oversight of safeguarding arrangements.
- Ensure effective safeguarding policies and procedures are implemented.
- Review serious safeguarding incidents.
- Ensure concerns are appropriately escalated to relevant authorities.
- Ensure lessons are identified and implemented.
- Promote an organisational culture in which safeguarding is everyone’s responsibility.
Workforce Governance
Ensure the organisation maintains appropriate systems for:
- Safer recruitment.
- DBS checks.
- References and employment histories.
- Training.
- Supervision.
- Appraisal.

- Disciplinary procedures.

- Safe staffing.
Duty of Candour
Promote an open and transparent culture and ensure the organisation complies with its statutory Duty of Candour obligations.

Escalate significant risks promptly and ensure the organisation responds effectively.

Key Relationship
The Nominated Individual provides senior organisational oversight.
The Registered Manager remains responsible for the day-to-day management of the regulated activity.
The Nominated Individual must therefore maintain sufficient independence, authority and oversight to effectively scrutinise and hold the Registered Manager accountable.
Pay: £50,000.00-£60,000.00 per year
